This statement applies to all computers, parts and/or services (where applicable) purchased from DNS Texas that are still in the warranty period or have current maintenance contracts active. I. DNS TEXAS CUSTOMER SATISFACTION GUARANTEE – RETURN POLICY
I. If you are not 100% satisfied with your new DNS Texas branded computer/server, purchased equipment or hosted service, you may return it within 10 days for a replacement or refund (less 15% restocking fee in physical product cases). Certain undocumented restrictions may apply for special situations, ask your DNS Texas sales representative for complete details if this applies to you! Hosted services include web hosting, enterprise e-mail, hosted virtual PBX services and virtual servers.

 

II. DELIVERY TIMES
II.I. CUSTOM COMPUTERS: Typically, new custom PCs take up to 4-5 business days to process. Day 1: Paperwork and coordination, getting the necessary parts pulled (or ordered), etc. Day 2: Receiving ordered part(s) (if applicable) and designing the new system layout. Day 3-4: Hardware build/software load starts, burn-in and appropriate testing on new hardware conducted. Day 4-5: Delivery or ‘blanket’ day for problems or issues that may arise. Special circumstances may require additional time, such as large quantities, excessive problems, etc. You can check on your order status at any time.

II.II. PART ORDERS ONLY: Part orders only can generally be shipped same day if order is in stock and ordered by 4pm CST. Any orders placed after 4pm CST that are in stock will be processed the next business day. If part(s) are not in stock you may be called to ask for a substitute part or to wait on part to come into stock. Orders placed on Fridays before 4pm CST will be processed and shipped on the following Monday. Orders placed over the weekends will be processed first thing Monday morning, this also includes website orders.

II.III. LENOVO BRANDED ORDERS: DNS Texas is a Lenovo partner and can sell all Lenovo products from home computers to enterprise servers. We can also customize certain Lenovo orders to meet your specs. Lead time for Lenovo products is 2-5 business days, depending on the level of customization and availability at the distribution center.

 

III. ORDERS
III. DNS Texas is not responsible or liable for orders that are unfulfilled due to incomplete or inaccurate information supplied by an end user or corporation. Any orders that are not complete or have substitute parts needed must be cleared with our contact (or authorized customer). If we can not reach you, your order will be placed on-hold until we get clearance from the original order placer or a suitable alternate decision maker.

 

IV. PAYMENT METHODS
IV.I CREDIT CARD ORDERS: DNS Texas accepts Visa, MasterCard, Discover, American Express and most Visa check cards. There are no additional fees invoked with using a credit card. There is a $30.00 declined credit card fee.  You will be notified if credit card payments fail.

IV.II COD ORDERS: DNS Texas will allow cash on delivery (COD) orders for select items and purchases, but must be paid on arrival before equipment is unloaded and installed at your location. COD checks must be completed onsite, have your work order number, drivers license number and telephone number clearly marked on them. There is a $35.00 returned check fee for any check that doesn’t clear when processed. You will be notified of an uncleared check as soon as possible. It is your responsibility to find alternate payment arrangements if an uncleared check is issued to us.

IV.III NET TERMS: Extended mainly to our corporate customers, unless other arrangements are pre-made. Net terms can range from 5 to 45 days dependent on credit ratings and previous payment history with DNS Texas. Declined net terms are not a reflection of personal or company credit, net terms are based on a trust between DNS Texas and yourself (or company).

IV.IV NON-PAYMENT FEES AND PROSECUTION: As stated above the following fee(s) can and will be charged when needed, you are responsible for these fees and any collection fees we encounter while pursuing required payment on your account.

IV.IV.I Visa, MasterCard, Discover, American Express and other charge cards accepted by DNS Texas are subject to an additional $30.00 fee if the card is processed and comes back declined for any reason. The card may be ran up to one (1) time(s) per business work week for up to one (1) month. You are charged the $30.00 fee ONE TIME only per billable invoice and will be notified upon any billing issues with credit cards.

IV.IV.II Bounced checks are subject to a $35.00 fee and are ran only once, If a check does not clear due to insufficient funds, etc. alternate payment arrangements must be made, another check may not be accepted. If alternate payment is not made within seven (7) days of the bounce check notification your account will go into possible collection status.

IV.IV.III Payments are due by the DUE DATE specified on your invoice. Generally, the due date is post-dated 7-15 days after your initial work order creation date. This allows time for mailing, etc. Payments that are received after the due date are immediately subject to a $25.00 late fee. Any open invoice account that is thirty (30) days or longer overdue will immediately be turned over to our collection department attorneys office for prosecution and further collections.

 

V. RETURNS AND EXCHANGES
V.I RMA PROCEDURE INFORMATION: If you are not 100% satisfied with your new DNS Texas branded computer (or a part purchased), you may return it within 14 days for a replacement or refund (less 15% restocking fee). Certain undocumented restrictions may apply for special situations, ask your DNS Texas sales representative for complete details if this applies to you! Before you can return any part or system sold by DNS Texas, you must obtain a return material authorization (RMA) number by either calling our central offices at 817.678.7350

V.II VOLUNTARY RETURN POLICY: If you are returning a unit/part due to change of mind, didn’t want, etc. The unit/part must be shipped to us in “as new” condition, including original packaging (if any), have all owners manuals and software with it and include any additional parts that the unit/part shipped with. Any discrepancies could result in delay or partial forfeiture of refund. There is a 15% restocking fee on parts or units returned. Return shipping costs are your responsibility.

V.III DOA (BAD PART) RETURN POLICY: If you are returning a unit/part due to it being dead on arrival (DOA) or not working properly, it too must be shipped back in “as new” condition (or as close to as possible). All manuals, accessories and software must accompany the unit/part. Any discrepancies could result in delays on getting replacement parts to you! There are no fees on units or parts being returned for “warranty” work. We pay shipping in situations like this (in most cases). If you qualify for returning a unit/part as documented in this section we will arrange to either pickup the part ourselves or send a carrier (such as UPS or FedEx) to get the unit/part from you.  This does not cover items purchased on eBay.

V.IV INCORRECT SHIPMENT RETURN POLICY: If you are returning a unit/part due to it being incorrectly shipped (wrong item received), you are entitled to a return at our expense (return shipping) and an immediate shipment of the correct part at no additional cost to you. You may also opt for a rain check (if requested part is not in stock) or credit to your account for the full purchase price. Please note unit must be unopened (if applicable) or sealed back up (if applicable) and returned to us the same way it was shipped to you.

VI. SOFTWARE RETURN POLICY
VI. Unopened software may be returned within fourteen (14) days of your invoice date. Defective software may be returned for the same product replacement within fourteen (14) days of the invoice date. No refunds are available on software.

 

VII. PRICES AND SPECIFICATIONS
VII. DNS Texas prices may vary with market conditions, market conditions can change regularly, sometimes daily. Although every effort is made to ensure both our inventory systems and web site are kept up-to-day accurate, there may be cases where published prices and specifications can change without notice. Prices quoted either in printed form or via web site do not include taxes (if applicable), shipping costs (if applicable), shipping insurance (if applicable) and/or delivery/installation fees (if applicable).

 

VIII. SYSTEM CONFIGURATION
VIII. DNS Texas will install any and all peripherals purchased with your new DNS Texas branded PC at no additional labor cost. Please note this only applies to new computer systems and parts purchased to go in this new system. If a part is purchased for a non-DNS Texas PC or is purchased for an existing DNS Texas branded PC and we install it, however, appropriate labor rates will apply. Parts must be purchased on the same order as the new PC to qualify. The complimentary configuration service includes operating system (O/S) installation, basic add-on products to the O/S, such as Internet Explorer, e-mail software, appropriate antivirus software, etc. It also includes such basic items as memory, tape drives, zip drives, network cards, modems, video cards, etc). Other system configurations (outside of basic setup) may require additional labor, which you will be notified of and be responsible for.

 

IX. WARRANTY INFORMATION
IX.I This section applies to NEW PARTS or SYSTEMS only. All new products are sold with original manufacturers limited warranties. Warranty periods vary from vendor to vendor and can range from months to years. Full vendor warranty information is available upon request. DNS Texas guarantees the 1st year on all new parts by offering our no questions asked exchange policy. For the 1st year, we will replace any failed component or unit at no charge to you (pending no physical damage or abuse has occurred). After the 1st year, you will need to contact the product vendor if vendor warranty exceeds 1 year. Certain items, such as hard drives and monitors usually have 2-4 year warranties as a standard option, even in this case, DNS Texas is responsible the 1st year, years 2-whenever are between yourself and the product vendor. your sales invoice lists all components in your system and has brand/model information listed to help you in the future!

IX.I.I The comprehensive DNS Texas 1st year warranty covers your part/unit from top to bottom, excluding “consumables”. Consumables can be any part that is too low priced to offer warranty on. Currently there are only four (4) products that DNS Texas considers consumables: CPU/CHASSIS FANS, MICE, MOUSE PADS and MICROPHONES. All other parts are completely covered, unless specifically stated on your invoice.

IX.I.II Your warranty period may be shortened and/or terminated for any of the following reason(s):

NEGLECT – Not caring for the equipment, damage by accident, damage by intention and not following normal care instructions of electronic equipment, such as sunlight exposure, extreme temperature ranges, etc.

ABUSE – Hitting or physically damaging equipment, not using proper electrostatic discharge (ESD) procedures when handling, etc.

ENVIRONMENTAL – Your warranty may be terminated or not fully honored for machines located in ‘extremely dirty’ environments, such as industrial workshops, ‘smoky environments’, where excessive cigar/cigarette smoking occurs, ‘extreme environments’ where the equipment is subject to sudden temperature changes, operating temperatures below 55F and/or over 95F, and in high traffic areas where equipment is likely to get jolted, kicked or be exposed to fluids, such as coffee and water.

*** You will be responsible for repairs on units/parts that have been abused or mistreated in any way ***

IX.II This section applies to USED or OPEN BOX products ONLY. Occasionally DNS Texas may offer re-certified/refurbished parts (if approved by you and we have the parts to use). These items are generally limited quantities and can be tested returns, closeout specials or discontinued products. Used or open box items may have some cosmetic damage, may be missing manuals or drivers. DNS Texas sells these products in an ‘AS-IS’ state. We guarantee the used or open box product to work and offer a seven (7) day guarantee on the open/used part. If the part fails in the seven (7) day grace period you will get credit for the product (when returned). No refunds are issued on used or open box product, although DNS Texas credits may be applied in some cases.

 

X. DNS TEXAS HOSTING/E-MAIL/SERVER GUIDELINES & SLA

X. DNS Texas offers web hosting and e-mail services, including hosted e-mail services to qualifying customers. Although we do not monitor content, the following restrictions do apply to all hosted accounts. [Updated: OCT 2014]

X.I Any website hosting illegal and/or pirated software, music and/or movies will not be tolerated and will be subject to removal with or without notice. Any legitimate software or files are allowed within your disk space allocation.  Malware and other forms of malicious software are prohibited.  You may not be eligible for continuing service with DNS Texas after piracy or malware related types of violation.

X.II Any e-mail abuse such as unauthorized mass mailing of unsolicited e-mails (aka: SPAM) will not be tolerated and may result in termination of service. Although mass mailing is allowed, for legit reasons by customers using DNS Texas services with accounts in good standing.  Virtual server cannot send e-mails out by default.  You must request this ability by completing the Virtual Server E-mail Request form.  We do not tolerate ‘spam’ being sent from our networks – if SPAM e-mails are detected or blacklisting of your IP occurs, your account will be suspended and may not qualify for re-activation.  Be sure to check with DNS Texas sales before signing up for services if you plan to mass-mail customers.  

X.III Falsifying of information to sign up for services will result in termination of account privileges, including access to all major access venues including WEBDAV, VPN, FTP and WEB/E-MAIL services. The termination may also include the shutting down of web services. The account de-activation may last until positive identification is presented or until the company or individual has corrected the incorrect information.  

X.IV Any hosted sites that go under DDoS attacks may have firewall rules forced on them to counter-act the attacks, this fire-walling may temporarily restrict access to your hosted website(s) from certain IP addresses or IP ranges until the attack passes. This is implemented to prevent flooding of resources that may affect other sites. You will be notified if this temporary fire-walling is ever enforced on your site(s). We do not hold customers responsible for DDoS attacks. Our network engineers will block offending attackers as needed to ensure your hosted services remain available.  

X.V 30 days termination notice is required for hosted services that you voluntarily wish to move to another host, this allows our team time to prepare with the necessary changes needed on the DNS Texas side, as well as provides time for the new host to get you operational. If you are moving hosting due to unresolved issues, conflict, content violations, terms of service (TOS) violations or failing to provide 30 day advance notice of hosting move – a service fee may be applied to your account. (variable rate, not to exceed $150.00 USD).  

X.VI Failure to pay for agreed services may result in termination of access to systems, including suspension of website and e-mail accounts. Your website may switch to a “Contact DNS Texas Billing” for unresolved issues. E-mail account(s) will be inaccessible and e-mails inbound will be ‘returned to sender’ in suspension mode. You can clear these issues up and restore services by contacting DNS Texas and correcting the problem that caused suspension.  

X.VII Sites that become infected accidentally or sites that intentionally are injecting malware into visitors browsers via vulnerabilities are subject to immediate suspension. If the bad content was unintentional, DNS Texas support services will assist with cleanup and attempt to identify the source (fees may apply). If bad content is intentionally injected into a hosted site with the intent to cause damage, Phish information or generally cause any type nuisance, the site will be suspended pending investigation. Authorities may be notified in some extreme cases and you may be ineligible for continuing services with DNS Texas.  

X.VIII Pre-paid hosting accounts may be terminated and moved to other hosts provided standard 30 day notice is provided (as stated above). Refund of unused pre-paid amount will be sent to the account holders primary address, less any applicable fees. Refunds of pre-paid services are performed via company check and may take up to two weeks to process and be received by account holder.  

X.IX DNS Texas has an average up-time of 99.54% – our standard service level agreement (SLA) guarantees average 99.00% up time on all or our services. Certain circumstances may occasionally occur, such as weather related incidents, broken fiber optics and other more rare internet outages that may affect your hosted services and access. We will credit accounts for extended outages that qualify for credit. Certain types of outages are completely out of our control, if outage continues for more than 4 hours our emergency co-lo sites will be brought up as primary sites to restore base services. Service credits may apply to all customers in this case. Credits for SLA are handled case-by-case.  

X.X Servers.  DNS Texas offers both virtual and dedicated servers for lease on a month to month basis.  We screen all applicants requesting dedicated and virtual servers and may deny the request based on screening results.  Dedicated and virtual servers may not be used in BOT activities, for SPAM related activities or any other malicious reason.  Failure to abide by these rules will result in termination of your server with or without warning.  Cancellations should be requested at least (7) days before your bill is due, failure to notify of a cancellation request may result in being billed an additional month, which will be not be refundable.  We reserve the right to terminate any server that is deemed malicious for any reason.  Unless specifically stated, you are fully responsible for your own data backups.  DNS Texas can provide backup services if needed, at additional cost.  We fully maintain dedicated server hardware and replace/repair as needed – this includes motherboard, memory, hard drive, etc.  Refunds are not issued for server hosting, please be sure you have contacted DNS Texas Sales and had all questions answered BEFORE purchasing any server based hosting services.  This is to ensure we can provide the requested services and that you fully understand the responsibility of using a dedicated or virtual server on our network.  We do not accept PayPal for server hosting due to former issues.  Server hosting must be paid for via credit card.

Addendum to section X.X – Appended January 2017 : Remediation and cleanup of damaged IP addresses due to abuse may incur additional fees to un-blacklist and/or replace.  These fines are charged $24.95/per IP address, per incident.

X.XI Bandwidth.  DNS Texas hosted services are provided, by default at up to 100mbps.  If you require additional bandwidth, you may request it at the current market rate of $4.00/mb – requests must be made in 25mb increments.  Bandwidth upgrade requests are only honored for trusted customers who have had services with DNS Texas in the past and/or for 30 consecutive days with no issues.  

X.XII IP Addresses.  DNS Texas, by default, hosts most services on shared IP addresses, meaning many services may utilize the same IP address but use different TCP or UDP port numbers.  We attempt to keep all major services on their own IP addresses.  Customers may request dedicated IP address(es) for their services in minimum blocks of (8) addresses.  The current market cost per IP address is $3.00, each 8 block added will incur additional monthly fees of approx $24.00.  IP address blocks requested in quantities under 16 are typically processed and available within (5) business days.  Larger blocks may require a slight amount more time while IP address justification forms are completed and processed.  Dedicated IP address requests are only honored for trusted customers who have had services with DNS Texas in the past and/or for 30 consecutive days with no issues.  Temporarily, we offer up to a single external, dedicated IP to get you started.

X.XIII Archives & Usage.  You may use your site for archiving, data storage, FTP, etc.  You should keep in mind that web sites are typically public and sensitive data should NOT be stored on your website, even if secured with username/password.  We offer proper secure backups that encrypt data and allow you non-public facing access (more info).  You may use your allocated disk space for any purpose as long as you are not breaking any law(s) or violating any of the above terms.

XI. DNS TEXAS CERTIFICATIONS
XI. All DNS Texas custom-built PCs are engineered with quality parts that meet or exceed FCC and UL certifications. This makes our machines and parts suitable for use in residential or commercial dwellings. All power supplies used by DNS Texas are certified and are ‘switching supplies’ – that shutdown if problems occur to prevent damage to components and structures. Our power supplies can run in 120v to 240v power situations.

 

XII. EXPORT OUTSIDE OF THE UNITED STATES
XII. To comply with certain vendor agreements and government regulations, DNS Texas reserves the right to refuse to export products from the United States at any time. If you are purchasing products for export, you are responsible for the necessary export documentation before shipment is made to a foreign country. Manufacturer warranties for parts and/or units leaving the United States may be null and/or void. It is your responsibility to contact vendors directly, based on your needs.

 

XIII. PRIVACY POLICY
XIII. This privacy policy has been compiled to better serve those who are concerned with how their ‘Personally identifiable information’ (PII) is being used online. PII, as used in US privacy law and information security, is information that can be used on its own or with other information to identify, contact, or locate a single person, or to identify an individual in context. Please read our privacy policy carefully to get a clear understanding of how we collect, use, protect or otherwise handle your Personally Identifiable Information in accordance with our website.

What personal information do we collect from the people that visit our blog, website or app?
When ordering or registering on our site, as appropriate, you may be asked to enter your name, email address, mailing address, phone number, credit card information or other details to help you with your experience.

When do we collect information?
We collect information from you when you register on our site, place an order, subscribe to a newsletter, respond to a survey, fill out a form or enter information on our site.

How do we use your information?
We may use the information we collect from you when you register, make a purchase, sign up for our newsletter, respond to a survey or marketing communication, surf the website, or use certain other site features in the following ways: To personalize user’s experience and to allow us to deliver the type of content and product offerings in which you are most interested, to allow us to better serve you in responding to your customer service requests, to quickly process your transactions, to send periodic emails regarding your order or other products and services.

How do we protect visitor information?
Our website is scanned on a regular basis for security holes and known vulnerabilities in order to make your visit to our site as safe as possible. We use regular Malware Scanning. Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems, and are required to keep the information confidential. In addition, all sensitive/credit information you supply is encrypted via Secure Socket Layer (SSL) technology. We implement a variety of security measures when a user places an order enters, submits, or accesses their information to maintain the safety of your personal information. All transactions are processed through a gateway provider and are not stored or processed on our servers.

Do we use ‘cookies’?
Yes. Cookies are small files that a site or its service provider transfers to your computer’s hard drive through your Web browser (if you allow) that enables the site’s or service provider’s systems to recognize your browser and capture and remember certain information. For instance, we use cookies to help us remember and process the items in your shopping cart. They are also used to help us understand your preferences based on previous or current site activity, which enables us to provide you with improved services. We also use cookies to help us compile aggregate data about site traffic and site interaction so that we can offer better site experiences and tools in the future. We use cookies to: Help remember and process the items in the shopping cart and to understand and save user’s preferences for future visits. You can choose to have your computer warn you each time a cookie is being sent, or you can choose to turn off all cookies. You do this through your browser (like Internet Explorer) settings. If you disable cookies off, some features will be disabled It won’t affect the users experience that make your site experience more efficient and some of our services will not function properly. However, you can still place orders .

California Online Privacy Protection Act
CalOPPA is the first state law in the nation to require commercial websites and online services to post a privacy policy. According to CalOPPA we agree to the following: Users can visit our site anonymously. Once this privacy policy is created, we will add a link to it on our home page, or as a minimum on the first significant page after entering our website. Our Privacy Policy link includes the word ‘Privacy’, and can be easily be found on the page specified above. Users will be notified of any privacy policy changes: On our Privacy Policy Page. Users are able to change their personal information: By calling us or By logging in to their account.

How does our site handle do not track signals?
We honor do not track signals and do not track, plant cookies, or use advertising when a Do Not Track (DNT) browser mechanism is in place.

Does our site allow third party behavioral tracking?
It’s also important to note that we do not allow third party behavioral tracking.

COPPA (Children Online Privacy Protection Act)
When it comes to the collection of personal information from children under 13, the Children’s Online Privacy Protection Act (COPPA) puts parents in control. The Federal Trade Commission, the nation’s consumer protection agency, enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children’s privacy and safety online. We do not specifically market to children under 13.

Fair Information Practices
The Fair Information Practices Principles form the backbone of privacy law in the United States and the concepts they include have played a significant role in the development of data protection laws around the globe.
